Master's Lecture, 2002

On Thursday 7 March 2002, members of the Company and guests gathered at Kings College, London to hear an excellent presentation by John Tackaberry.
John Tackaberry QC is a Recorder and internationally-renowned advocate and arbitrator. He is a Past Chairman of the Chartered Institure of Arbitrators, founding President of the Society of Construction Law and Past President of the European SCL. He is also a present (or past) member of many international arbitration panels. He is Visiting Professor in Construction Law at Queensland University of Technology and a Commissioner of the United Nations Compensation Commission.
In his presentation, John asked the critical questions:
"Is arbitration arthritic and fixed in its ways?"
"Are Arbitrators using all the weapons in their armoury?"
The process of arbitration is generally binding and conclusive, unlike mediation or conciliation, which could be seen as "competitors". The Arbitrator and the process of arbitration must therefore deliver a quality product using the most expedient and cost-effective tools available whilst maintaining flexibility.
John encourages Arbitrators to think carefully about what they are doing and how they are delivering the service so that any arthritic problems may be palliated or cured.
