PROFILE Matthew is an experienced dispute resolver and has been appointed in over 900 construction and engineering disputes as either adjudicator, arbitrator, mediator, expert determiner, Conflict or Dispute Avoidance Panel/Board member. These disputes have concerned a number of high-profile projects both within the UK and overseas, and have involved complex technical and legal issues in a variety of sectors, including education, private and public housing, offices, hotels and leisure, sports stadia, roads and infrastructure, utilities, energy and process engineering.

He is also on the RICS select panel of construction and engineering arbitrators and has been appointed by the ICC and DIFC-LCIA (now DIAC) in relation to international arbitrations. Matthew is frequently named and agreed by parties and their representatives to act as dispute resolver both before and after disputes have arisen. Matthew’s work as a mediator predominantly concerns construction and property related disputes including multi-party disputes, disputes involving public and private bodies, private individuals and insured professionals.

PROFESSIONAL MEMBERSHIPS & ENGAGEMENTS Matthew is a member of the Society of Construction Law, the Adjudication Society, ARBRIX, the Arbitration Club (Law Courts Branch), the LCIA and the Society of Construction Arbitrators. He is the current Chair of the CIC ADR Management Board and current Master of the Worshipful Company of Arbitrators. Matthew is also at present a teaching fellow and part-time PhD Student at Queen Mary University of London. He is also a Course Director/Tutor for the RICS Diploma in Adjudication, acts as moderator and assessor for the RICS Diploma in Arbitration (Domestic and International), part-time Lecturer at City University and former External Examiner for the MSc/LLM Construction Law & Dispute Resolution at Leeds Beckett University. In addition, he chairs Adjudicator, Arbitrator, Fellowship and Chartered Arbitrator assessment panels for the RICS and CIArb. Matthew has also acted as Honorary Secretary of CIArb London Branch and has served on and/or chaired the RICS Dispute Resolution Faculty Board, Dispute Resolution Policy Committee, and a number of RICS, CIArb and CIOB Working Groups. Matthew regularly conducts training and gives lectures / presentations on construction law and dispute resolution topics and is on the Editorial Consultation board of Practical Law. In 2024, Matthew co-authored his first book entitled “Adjudicating Construction and Engineering Disputes”.

CAREER SUMMARY Matthew has worked in the construction industry since 1987. He qualified as a Chartered Quantity Surveyor in 1993, having completed his studies whilst working with a national contractor. After qualification he joined a regional contractor where, after undertaking an MSc in Construction Management and qualifying as a Chartered Builder, he progressed to contracts management. Since forming MCMS in 1996, Matthew has specialised in providing quantity surveying services, contract advice and dispute resolution services to a wide variety of clients. He is a Fellow of the Chartered Institute of Arbitrators and a Chartered Arbitrator. He trained as a mediator with CEDR and was called to the Bar in 2001. He has been appointed as adjudicator, arbitrator, expert determiner or mediator on over 900 occasions, acting as tribunal in construction and engineering disputes ranging in value up to £110m, including PFI, PPP and utility contracts including disputes arising under the FIDIC, NEC, JCT, GC/Works standard forms as well bespoke contracts. 1996 – Present: MCMS Limited, London EC2A – Director Matthew formed MCMS Limited in April 1996 with the objective of providing professional quantity surveying and construction management consultancy services within the construction industry. Since its formation, MCMS has provided a variety of services to diverse types of client, both in the UK, Europe and the Middle East. Examples of work undertaken include the preparation of tender documentation and departmental procedures, the review of contractual arrangements, the review of firms’ health and safety arrangements in the light of CDM Regulations, the preparation of budget estimates and bills of quantity, the compilation of tenders, post contract quantity surveying services, building surveying services, contract administration, the preparation of final accounts, auditing, dispute resolution, expert advice on contractual disputes and professional negligence, the preparation, assessment and negotiation of loss and expense claims, expert witness work in arbitration and litigation proceedings and advocacy in adjudication and arbitration proceedings. Most of Matthew’s time is now spent acting as adjudicator, arbitrator, mediator, expert or expert determiner. Matthew has been involved with several high-profile projects, including the Millennium Dome, the Channel Tunnel Rail Link, the Royal Albert Hall, Merrill Lynch’s European Head Office, Somerset House and the redevelopment of Hungerford Bridge and a broad range of disputes concerning building, engineering, infrastructure, rail and PFI projects. 1993 – 1996: DJ Higgins & Sons Limited – Contracts Surveyor/Contracts Manager Matthew joined DJ Higgins initially as a contract surveyor, but progressed to act as contracts manager, with responsibility for several social housing schemes. 1988 – 1993: Hall & Tawse Construction Limited (formerly Walter Lawrence) – Contracts Surveyor Matthew was initially employed as an assistant surveyor and progressed to the position of contracts surveyor with responsibility for several new build and refurbishment projects in the private commercial sector. 1987 – 1988: Willmott Dixon Symes Limited – Trainee Surveyor Matthew spent short periods of time in the estimating, planning, buying and contracts departments, with most of his time spent in the Surveying department with involvement in three new build and refurbishment projects in the private commercial sector.

OTHER INTERESTS Matthew used to be a competitive swimmer and triathlete. He is also a Level 3 senior swimming coach, having worked with Enfield Swim Squad, the British Amputee & Les Autres Sports Association, London University Swimming Team and Camden Swiss Cottage Swimming.
